The Imo State High Court on Thursday presided over by Justice Victoria. C. Isiguzo, struck out an application for stay of execution brought by Victor Oye, seeking to stop an earlier judgement which ordered the Independent National Electoral Commission, INEC, to recognize Chukwuma Umeoji, as the All Progressive Grand Alliance, APGA, governorship candidate for the November 6 governorship election in Anambra State.
But the court granted Oye the leave to appeal but did not grant him the order of stay of execution as requested against the judgement earlier delivered by Justice B. C. Iheka in favour of Umeoji.
The Court of Appeal Kano Division had on the 10th of August, 2021 set aside another judgment of the Jigawa High Court which also held that Chief Jude Okeke wws National Chairman of APGA and only governorship Congress held by him shall be valid.
In the judgment of Justice B. C. Iheka, on Thursday, the Independent National Electoral Commission (INEC) was directed to accept and continue to recognize and publish the name of Hon. Chukwuma Umeoji as the candidate of the party and to include his name in all electoral processes for the Anambra governorship election.
The court stated that INEC cannot evade its duty to comply with the orders of the court declaring Umeoji candidate and therefore had a legal obligation to continue to carry out and comply with the subsisting judgment of the Court delivered on 28th July, 2021 pending the determination of the appeal filed by Victor Oye at Appeal Court Owerri.
